When renting a commercial retail space, should it be up to code even if you rent "as is"?
If it's an old building, and the landlord says "as is" Does that mean that the tenant is responsible for bringing it up to code, or just for repairs or changes? For example, what if the toilet does not work? Can they rent a retail space without it working.... what it the deal?

With a commercial property/lease "as-is" means that you will making all the necessary repairs and alterations to the leasehold. The landlord is not responsible for anything other what is stated in the lease agreement. With my commercial lease it states that I'm am not required to pay for any additions or modifications and the tenant is totally responsible for such changes. I also post a notice on the building "Notice Of Non-Responsibility" stating that I am not responsible for any Mechanic's Liens that the tenant may have caused. I am also required to record that notice with the County Recorder.
A residential lease is much more strict concerning tenants rights. In a commercial lease the law views the tenant as a more savvy tenant and gives the landlord much more leeway.
In my city the commercial tenant must obtain a "certificate of occupancy" (which requires a city inspection making sure that the leased premises is up to code) and a business license. The adding or modification of the electrical or mechanical systems would also require a building permit.
